We understand the laws behind cannabis and hemp can be confusing. Here are some answers.

Cannabis in South Africa has been decriminalised by the country’s Constitutional Court for personal consumption by adults in private. Any recreational use, possession or cultivation of cannabis which is not done in by an adult in private is an offence under the Drugs Act. That being said, you may cultivate cannabis in your private space, with limitations on they amount that may be cultivated.

This is not an easy one. There are a handful of facilities cultivating THC-based cannabis products in South Africa. However, this process is not an easy feat. One of the main factors to keep in mind is the obscure and large amount of investment required to produce medicinal cannabis. It is not an impossible process but with the right amount of time, patience and focus, it can be done. Nonetheless a license would be required by SAPHRA (the South African Health Products Regulatory Authority).

This is by far the easiest permit to acquire. There is a large amount of requests to start hemp cultivation since the passing of the bill in October 2021. Hemp is a cannabis derived plant that has many uses. Some of these uses include biomass, hurd, fiber, nutrition and biodiesel.

This depends on the type of cultivation being done. Under a THC cultivation license most of the biomass will be exported to other countries for further processing or consumption. THC products can be extracted here as well. But once again, for export purposes. All biomass will be accompanied with a COA (Certificate of Analysis) done by a lab. This is a crucial part of the industry. CBD is more easily to attain as it is distributed locally. Hemp can be processed to produce a large variety of products.

After the court ruling against THC (The Haze Club), cannabis clubs have been deemed illegal. We have unfortunately put that portion of our business dealings on hold as it is unconstitutional and deemed illegal. We are working as an industry to further the progress and allow legal consumption in such institutions.
